ZONASATUNEWS.COM— Tentara Nasional Indonesia (TNI) baru saja menyatakan siaga tempur di wilayah perairan Kepulauan Natuna dan sekitarnya. Sikap itu diambil tak lepas dari gelagat China yang mengklaim berdaulat di perairan tersebut sehingga kapal-kapalnya bebas berlayar.

Guna mendukung operasi siaga tempur, TNI mengirim 3 kapal, 1 pesawat intai maritim dan 1 pesawat Boeing. Merujuk dari laman globalfirepower.com, Indonesia memiliki armada laut yang lebih besar dari itu.

Namun sikap TNI yang siapa tempur itu tidak sejalan dengan Menteri Pertahanan Prabowo Subianto. Prabowo lebih memilih berunding untuk menyelesaikan konflik laut Natuna Utara.

Di tengah pernyataan antara pemerintah Indonesia dan pemerintah China, Menhan Prabowo menyampaikan, “Kita tentunya gini, kita masing-masing ada sikap. Kita harus cari satu solusi baik lah di ujungnya. Saya kira ada solusi baik”.

Menurut pengamat hubungan internasional UI, Hikmahanto Juwana, Indonesia tidak dalam situasi akan berperang karena adanya pelanggaran yang dilakukan oleh Coast Guard China. Adapun wilayah laut yang diklaim oleh Indonesia adalah wilayah hak berdaulat (sovereign right) bukan wilayah kedaulatan (sovereignty) Indonesia.

Perlu dipahami, wilayah di mana ada hak berdaulat dalam hukum laut berada di wilayah laut bebas, bukan di wilayah laut teritorial.

“Dalam konteks demikian pengerahan kekuatan TNI tidak dapat dilakukan di ZEE. Otoritas yang wajib dikerahkan adalah otoritas yang melakukan penegakan hukum,” ujar Hikmahanto.

Di Indonesia otoritas tersebut adalah Bakamla, KKP dan TNI-AL. Atas dasar ini solusi dalam bentuk perundingan dalam isu Natuna Utara sebagaimana yang disampaikan oleh Menhan tidak memiliki dasar di samping memang tidak diperlukan.
