MK Tolak Uji Materi “Presidential Threshold”

JAKARTA (Zonasatu News) – Mahkamah Konstitusi menolak uji materi pasal 222 Undang-Undang Nomor 7 tahun 2017 tentang Pemilihan Umum. Uji materi ini diajukan Partai Idaman yang teregistrasi dengan nomor 53/PUU-XV/2017.

“Menolak permohonan pemohon untuk selain dan selebihnya,” kata Ketua Mahkamah Konstitusi Arief Hidayat saat membacakan putusan di Gedung MK, Jakarta, seperti dilansir kompas.com (11/1/2018).

Adapun pasal 222 mengatur ambang batas pencalonan presiden atau presidential threshold.

Partai politik atau gabungan parpol harus memiliki 20 persen kursi DPR atau 25 persen suara sah nasional pada pemilu 2014 lalu untuk bisa mengusung pasangan capres dan cawapres.

Dalam dalil yang diajukan, Partai Idaman diantaranya menilai pasal tersebut sudah kedaluwarsa karena menggunakan hasil pileg 2014 sebagai ambang batas pilpres 2019.

Partai Idaman juga menilai pasal tersebut tak relevan karena pileg dan pilpres 2019 digelar secara serentak.

Selain itu, Partai Idaman juga menilai pasal tersebut diskriminatif karena menghalangi partai politik baru untuk mengajukan capres.

Namun, dengan ditolaknya uji materi yang diajukan Partai Idaman, maka ketentuan pasal tersebut tak berubah dan dinyatakan sah.

Dalam pertimbangannya, MK menilai presidential threshold relevan untuk memperkuat sistem presidensial.

Dengan presidential threshold, maka Presiden yang terpilih nantinya bisa memiliki kekuatan di parlemen.

MK juga menilai pasal 222 tidak kedaluwarsa karena merupakan UU baru yang disahkan pemerintah dan DPR pada 2017 lalu, bukan UU lama yang digunakan untuk menggelar pilpres 2014. MK juga menilai pasal 222 tidak bersifat diskriminatif.

Kendati demikian, MK mengabulkan permohonan Partai Idaman terhadap uji materi pasal 173 ayat (1) dan (3) UU Pemilu.

Dengan dikabulkannya permohonan ini, maka partai lama peserta pemilu 2014 harus tetap menjalani verifikasi faktual.

“Mengabulkan permohonan untuk sebagian,” kata Arief.

Ada dua hakim MK yang mengajukan disssenting opinion atau perbedaan pendapat terkait putusan MK terhadap uji materi pasal 222, yakni Saldi Isra dan Suhartoyo.

Kedua hakim sepakat ketentuan presidential threshold dalam pasal 222 itu dihapus.

Selain Partai Idaman, ada sejumlah pihak lain yang juga mengajukan uji materi pasal 222 UU Pemilu. Diantaranya adalah Habiburokhman dengan nomor 44/PUU-XV/2017,

Effendi Gazali dengan nomor 59/PUU-XV/2017, Hadar Nafis Gumay dengan nomor 71/PUU-XV/2017 serta Mas Soeroso dengan nomor 72/PUU-XV/2017
