ZONASATUNEWS.COM — Persoalan memanasnya kawasan Natuna Utara setelah terjadinya pengusiran kapal nelayan Indonesia oleh Cost Guard China mendapat respons Guru Besar Hukum Internasional Universitas Indonesia Hikmahanto Juwana.

Pengamat HI Sayangkan Pernyataan Prabowo yang Tak Sejalan Dengan Menlu. Menurutnya, masalah Natuna Utara tidak seharusnya diselesaikan di meja perundingan mengingat China tidak mengakui Zona Ekonomi Eksklusif (ZEE) Natuna Utara.

“Sementara Indonesia tidak mengakui klaim traditional fishing right China,” kata Hikmahanto seperti dilansir Antara pada Jumat (3/1/2020).

Selain itu, Hikmahanto menyayangkan pernyataan Menteri Pertahanan Prabowo Subianto soal Natuna Utara. Di tengah pernyataan antara pemerintah Indonesia dan pemerintah China, Menhan Prabowo menyampaikan, “Kita tentunya gini, kita masing masing ada sikap. Kita harus cari satu solusi baik lah di ujungnya. Saya kira ada solusi baik”

“Pernyataan tersebut disayangkan,” kata Hikmahanto.

“Seharusnya Menhan sebagai bagian dari pemerintah harus satu suara dengan suara pemerintah yang disampaikan oleh Menlu Retno Marsudi di Kantor Menko Polhukam,” tambahnya.

Langkah nyata yang perlu dilakukan oleh pemerintah, menurutnya, adalah meningkatkan patroli di Natuna Utara dan melakukan penegakan hukum bila ada nelayan asing, termasuk asal China yang melakukan penangkapan ikan secara ilegal.

“Peningkatan patroli juga bertujuan agar nelayan-nelayan Indonesia saat melakukan aktivitasnya tidak mendapat gangguan dari kapal-kapal Coast Guard China,” kata dia.

Perlu dipahami, Indonesia tidak dalam situasi akan berperang karena adanya pelanggaran yang dilakukan oleh Coast Guard China.

Adapun wilayah laut yang diklaim oleh Indonesia adalah wilayah hak berdaulat (sovereign right) bukan wilayah kedaulatan (sovereignty) Indonesia.

Perlu dipahami, wilayah di mana ada hak berdaulat dalam hukum laut berada di wilayah laut bebas, bukan di wilayah laut teritorial.

“Dalam konteks demikian pengerahan kekuatan TNI tidak dapat dilakukan di ZEE. Otoritas yang wajib dikerahkan adalah otoritas yang melakukan penegakan hukum,” ujar Hikmahanto.

Di Indonesia otoritas tersebut adalah Bakamla, KKP dan TNI-AL. Atas dasar ini solusi dalam bentuk perundingan dalam isu Natuna Utara sebagaimana yang disampaikan oleh Menhan tidak memiliki dasar di samping memang tidak diperlukan.
