Tim PH Gus Nur Protes, Sidang Berikutnya Berlangsung Offline

ZONASATUNEWS.COM, JAKARTA – Selasa, 20 Desember 2022 telah dilangsungkan sidang pertama terdakwa Bambang Tri Mulyono dan Sugu Nur Raharja alias Gus Nur dengan agenda pembacaan dakwaan.

Sidang berlangsung pukul 10.30 WIB secara online tanpa kehadiran kedua terdakwa. Melihat hal tersebut Penasihat hukum Gus Nur menyampaikan protes.

“Kami menginginkan terdakwa hadir di persidangan sebab di persidangan lain di Jakarta yang mengadili tokoh-tokoh penting terdakwa tetap dihadirkan,” protes Ahmad Khodinudin penasihat hukum Gus Nur dan Bambang Tri.

Pernyataan itu sejalan dengan keinginan kedua terdakwa. Karena sidang tidak akan fair sebab kualitas audio dan gangguan sinyal pasti terjadi.

Dr. Muhammad Taufiq,S.H.,M.H selaku Dosen Universitas Islam Sultan Agung Semarang yang ikut hadir di Pengadilan Negeri Surakarta, saat diwawancara wartawan menjelaskan, bahwa persidangan harus dilaksanakan di ruang sidang pengadilan dengan dihadiri oleh penuntut umum dan terdakwa dengan didampingi oleh penasihat hukum.

”Persidangan harus dilaksanakan berdasarkan aturan hukum acara. Jika menginginkan online itu harus berdasar kesepakatan Majelis Hakim, Jaksa Penuntut Umum, Penasihat Hukum dan terutama Terdakwa. Hal itu dijelaskan dalam Pasal 2 Perma no 4 tahun 2020 Tentang Sidang Elektronik,” Muhammad Taufiq 

Sebagaimana permintaan dari Gus Nur yang menginginkan persidangan dilakukan secara Offline, Gus Nur juga menjelaskan bahwa dirinya sudah bersikap kooperatif selama 2 bulan belakangan ini dengan menaati aturan penahanan di Rutan Polresta Surakarta dalam kondisi yang di isolasi serta terbatasnya akses dari di dunia luar.

Sebelumnya terjadi perdebatan sengit terjadi yang akhirnya permintaan tim penasihat hukum dikabulkan yakni untuk sidang berikutnya akan berlangsung secara off line alias semua hadir di pengadilan.

Sebelum itu, Gus Nur juga sempat menuliskan surat yang ditujukan kepada Majlis Hakim supaya sidang bisa dilaksanakan secara offline. Ia juga menyampaikan dalam surat yang ia tulis di atas secarik kertas tersebut bahwa ia merasa dirinya diperlakukan tidak layak mengingat dia bukanlah teroris yang bisa membahayakan masyarakat. Gus Nur juga menerangkan jika dihalangi untuk bertemu dengan keluarga bahkan hanya sekedar untuk membalas voice note dari anaknya pun tak bisa.

Sebelum sidang dimulai di halaman pengadilan Surakarta sejumlah Penasehat Hukum Bambang Tri Mulyono dan Gus Nur yang tergabung dalam Tim Advokasi Gus Nur seperti Ahmad Khosinudin, Andhika dan Mustofa menyampaikan keberatan atas dilaksanakannya persidangan pertama secara online.

Meskipun ini merupakan sidang pertama dengan agenda pembacaan dakwaan, akan tetapi pihak Penasehat Hukum terdakwa beralasan justru pada sidang pertama inilah merupakan momentum krusial yang seyogyanya dihadiri langsung oleh para terdakwa.

Hal tersebut supaya para terdakwa bisa mendengar secara langsung dakwaan yang dibacakan oleh JPU dan apabila terdapat kekeliruan di dalamnya, para terdakwa bisa langsung menyampaikan keberatannya.

Alasan lainnya adalah mengingat sidang yang dilaksanakan secara online rentan terjadi gangguan seperti hilang sinyal dan tidak terdengarnya audio. Karena alasan itulah kemudian pihak Penasehat Hukum Gus Nur memohon agar sidang dilaksanakan secara offline.

“Sampai pada keberatan itu diajukan, akhirnya oleh Majlis Hakim memutus bahwa sidang berikutnya Para Terdakwa dihadirkan di muka sidang,” kata Ahmad Khosinudin.
