ZonasatuNews–WAKIL PRESIDEN Jusuf Kalla menolak rencana pembentukan detasemen khusus tipikor Polri. Wapres menilai, tidak perlu ada tim baru untuk pemberantasan korupsi, tapi cukup difokuskan saja ke KPK. Kata Wapres, KPK harus dibantu agar bisa bekerja dengan baik.

Penolakan yang diutarakan Wapres itu menyiratkan sesuatu yang serius. Pertama, menunjukkan tingkat koordinasi internal pemerintah. Muncul pertanyaan, apakah rencana merealisasikan gagasan pembentukan densus itu tidak dibahas dulu antarlembaga di pemerintah? Jawabannya, tentu belum. Sebab, kalau sudah, tak mungkin Wapres bersuara seperti itu. Penolakan Jusuf Kalla menunjukkan bahwa pemerintah belum membahas ini secara tuntas dan komprehensif.

Penolakan Jaksa Agung terhadap opsi pengelolaan densus yang ditawarkan Kapolri juga memperkuat dugaan nirkoordinasi tersebut. Seperti kita beritakan kemarin, Kapolri mengusulkan dua opsi operasionalisasi densus yang akan dibentuknya itu. Salah satunya, dibentuk sistem kerja satu atap yang dipimpin secara kolektif kolegial oleh perwira tinggi bintang dua, perwakilan kejaksaan, dan perwakilan Badan Pemeriksa Keuangan. Tujuannya, agar berkas penyidikan yang sudah selesai dari densus tidak bolak-balik ke kejaksaan. Jaksa Agung menolak, karena cara kerja seperti itu bertentangan dengan KUHAP.

Tidak adanya koordinasi tersebut, terus terang, tidak baik dampaknya bagi citra pemerintah. Karena bagaimana pemerintah bisa mengkoordinasi dalam skala lebih luas, jika di internalnya sendiri terkesan centang-perenang. Bagi efektivitas pemerintah, yang mensyaratkan adanya soliditas, hal tersebut adalah aurat yang tabu jika terlihat,

Kedua, menunjukkan perbedaan pandangan antara presiden dan wakil presiden. Presiden Joko Widodo memang belum mengutarakan sendiri pendapatnya. Tapi, Juru Bicara Kepresidenan Johan Budi menyatakan, bahwa rencana pembentukan densus tipikor oleh Polri tidak perlu dipersoalkan. Sebab, ujar Johan, yang menjadi perhatian Presiden Joko Widodo adalah pemberantasan korupsi bisa dilakukan secara cepat. Pernyataan dari juru bicara resmi kepala negara itu bisa menjadi rujukan untuk menilai sikap Presiden.

Kita tidak tahu persis, apakah Kapolri hanya menyampaikan rencana pendirian densus itu hanya kepada Presiden. Tetapi, sekali lagi, melihat penolakan Wapres, hampir pasti memang hanya Presiden Jokowi yang dilapori Kapolri.

Secara hukum, memang tak ada kewajiban pejabat tinggi negara melapor kepada wapres. Menteri atau pejabat setingkat menteri bertanggungjawab kepada presiden. Dalam UUD NRI 1945, tugas wakil presiden hanya membantu presiden melakukan kewajibannya. Itu sebabnya, wapres sering disebut sebagai “ban serep” –mengikuti istilah mantan Wapres AS, John N. Garner, bahwa wakil presiden itu hanya bagaikan a spare tire on the automobile of government.

Meski tidak ada kewajiban konstitusional menteri atau pejabat setingkat menteri untuk melapor kepada wapres, rumusan konstitusi itu jangan dipahami secara mentah dan tekstual saja. Presiden dan wapres itu dipilih satu paket dalam pemilu. Itu artinya, meski keduanya dibedakan dengan status “orang pertama” dan “orang kedua”, sejatinya mereka adalah dwitunggal.

Pemahaman tekstual memang perlu, tetapi penerapan hukum mesti pula mempertimbangkan aspek-aspek lain yang di luar teks. Dalam konteks melapor kepada wakil presiden ini, aspek kepatutan perlu dipertimbangkan.

Kepatutan itu bisa diukur dengan melontarkan pertanyaan: Patutkah jika untuk urusan sepenting ini, wapres tidak dimintai pendapat atau setidaknya diberi tahu? Dalam kepatutan ini bukan semata pasal-pasal hukum, tapi perkara rasa. Rasa apa yang terlintas jika berbicara kepada yang satu, tapi mengabaikan yang lain.(Sumber: Nusantara.news)
