ZONASATUNEWS.COM, JAKARTA — Wacana penundaan jadwal Pemilu 2024 diutarakan sejumlah tokoh politik.

Ahli hukum tata negara Yusril Ihza Mahendra mengatakan, sejauh ini tidak ada lembaga yang berwenang untuk melakukan penundaan pemilu.

“Sebagai negara hukum, kita wajib menjunjung hukum dan konstitusi. UUD 1945 tegas mengatakan bahwa pemilu diselenggarakan sekali dalam lima tahun. Undang-undang juga demikian. Kalau pemilu ditunda, maka lembaga apa yang berwenang menundanya?” kata Yusril dalam keterangan tertulis, Jumat (25/2/2022).

Yusril menuturkan, konsekuensi dari penundaan pemilu harus dipertimbangkan, karena masa jabatan presiden, wapres, kabinet, DPR, DPD dan MPR akan habis dengan sendirinya.

“Lembaga apa yang berwenang memperpanjang masa jabatan para pejabat negara tersebut? Apa produk hukum yang harus dibuat untuk menunda pemilu dan memperpanjang masa jabatan?” ujar Yusril.

Mantan Menteri Hukum dan HAM itu mengatakan, apabila hanya asal tunda pemilu dan asal perpanjang masa jabatan para pejabat negara tanpa dasar konstitusional dan pijakan hukum yang kuat, maka ada kemungkinan timbul krisis legitimasi dan krisis kepercayaan.

“Keadaan seperti ini harus dicermati betul, karena ini potensial menimbulkan konflik politik yang bisa meluas ke mana-mana,” kata Yusril.

Menurut Yusril, dalam negara demokrasi, setiap orang boleh mengusulkan apa pun. Tetapi, usulan penundaan pemilu, menurut Yusril, berbenturan dengan Konstitusi Undang-Undang Dasar 1945 dan regulasi lain.

Amandemem UUD 45 menyisakan persoalan besar bagi bangsa kita, yakni kevakuman pengaturan jika negara menghadapi krisis seperti tidak dapatnya diselenggarakan Pemilu.

Sementara tidak ada satu lembaga apapun yang dapat memperpanjang masa jabatan Presiden atau Wakil Presiden, atau menunjuk seseorang menjadi Pejabat Presiden seperti dilakukan MPRS tahun 1967.

Sebagaimana diketahui, wacana penundaan Pemilu 2024 mengemuka setelah diutarakan oleh Ketua Umum Partai Kebangkitan Bangsa (PKB) Muhaimin Iskandar. Bahkan, Cak Imin dikabarkan hendak menemui Presiden Joko Widodo terkait wacana tersebut.

Sebelumnya, wacana yang sama juga pernah dikemukakan Menteri Investasi Bahlil Lahadalia. Penundaan pemilu dinilai perlu untuk keberlanjutan pemulihan ekonomi masa pandemi, serta menghindari stagnasi program pembangunan, sebagai imbas peralihan kekuasaan.
